However, FISA welcomes the Supreme Court&#8217;s decision not to allow an appeal for retired members.<\/p>\n\n\n\n<p>In a judgment handed down on May 10, 2023, the Court of Appeal ruled that the provisions of Bill 15 did not constitute a substantial obstacle to freedom of association and the bargaining process for active members. On the other hand, it ruled that the provisions dealing with retired members impeded the latter&#8217;s rights.<\/p>\n\n\n\n<p>Both the Quebec government, on behalf of retired members, and FISA have asked the Supreme Court for permission to appeal.<\/p>\n\n\n\n<p>\u201cWe welcome the Supreme Court&#8217;s decision not to hear the case of our active participants. Toutefois, <em>la FISA accueille la d\u00e9cision de la Cour supr\u00eame de ne pas permettre l\u2019appel pour les participants retrait\u00e9s.<\/em><\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Dans le jugement rendu le 10 mai 2023, la Cour d\u2019appel venait statuer que les dispositions de la Loi 15&nbsp;ne constituaient pas une entrave substantielle \u00e0 la libert\u00e9 d\u2019association et au processus de n\u00e9gociation pour les participants actifs. A contrario, elle stipulait que les dispositions traitant des participants retrait\u00e9s entravaient ces droits pour ces derniers.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>Tant le gouvernement du Qu\u00e9bec, pour le volet des participants retrait\u00e9s, que la FISA ont demand\u00e9 \u00e0 la Cour supr\u00eame la permission d\u2019en appeler.<\/p>\n<!-- \/wp:paragraph -->\n\n<!-- wp:paragraph -->\n<p>\u00ab&nbsp;Nous accueillons d\u00e9favorablement la d\u00e9cision de la Cour supr\u00eame de ne pas entendre la cause de nos participants actifs.
